Thyme Care Inc. (“Thyme Care”, “we”, “us” and/or “our”) is committed to protecting your privacy. This Privacy Policy describes how Thyme Care may collect, store, use, process, or otherwise handle certain types of personal information in the provision of our products and services. Our Privacy Policy also describes the controls we provide to you to manage the use of your personal information. This Privacy Policy governs the web site (the “Site”) of Thyme Care Inc. and its affiliates (“Thyme Care”, “we”, “us” and/or “our”). This Site is operated by Thyme Care and has been created to provide information about Thyme Care, our related services, and our interactions with you (together with the Site, the “Services”). This Privacy Policy sets forth Thyme Care’s policy with respect to Personal Data that is collected through the Services. From time to time, we may supplement this Policy with additional information about our privacy practices related to a particular activity Thyme Care undertakes. As described in the Thyme Care Terms of Use, the Services may allow you to connect with a Thyme Care Medical PLLC, health care provider (a “Provider”) to provide certain medical services, including the Telehealth Services (as defined in the Thyme Care Terms of Use). By accessing or using the Services, you acknowledge that you have read, understand, and agree to be bound by this Privacy Policy. If you do not agree to these terms, do not use the Services.
We may collect certain health information in the context of our provision of Services to you and our health care providers and health plan customers. If you are a patient or member of a Thyme Care customer that is a healthcare provider or health plan subject to the Health Insurance Portability and Accountability Act (“HIPAA”), then our agreement with your healthcare provider and health plan will govern how we use and share your “protected health information” as defined by HIPAA. If you have any questions about the privacy of your protected health information, please contact your healthcare provider or health plan.
Personal Data We Collect:
“Personal Data” is data relating to an identified or identifiable natural person. Depending on the nature of your interactions with the Services, we may collect the following Personal Data from or about you:
- Direct identifiers, such as your name, address, email address, phone number, and other contact information;
- Job applicant information, such as your resume, curriculum vitae, employment history, educational history, references, qualifications, and demographic information you voluntarily provide to us;
- Health information, such as symptoms or test results that you, our healthcare providers or health plan customers may share with us as part of the Services;
- Financial information and residency status only in the event you request that we assist with filing grant applications on your behalf;
- Information collected through automated data collection technologies, such as “cookies.” For example, we may collect information that helps us track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors' Internet service providers.

Thyme Care uses Personal Data in a manner that is consistent with this Privacy Policy. We may use Personal Data in order to provide the Services to our health care provider and health plan customers. In addition, if you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by email to ask a question, we will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data in order to obtain access to the Services, we will use your Personal Data to provide you with access to, and monitor your use of, such Services.
Thyme Care may also use your Personal Data collected through the Services to help us improve the content and functionality of the Services, to better understand our users and to improve the Services. Thyme Care may use this information to contact you in the future to tell you about services we believe will be of interest to you. This includes contacting you for marketing and promotional purposes by various means, including email, mail, and telephone. If we do so, each marketing communication we send you will contain instructions permitting you to "opt-out" of receiving future marketing communications. Operational and other non-marketing communications regarding use of the Services may not contain “opt out” instructions. In an ongoing effort to better understand and serve the users of the Services, Thyme Care often conducts research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Thyme Care may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. Thyme Care may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.
Our Disclosure of Your Personal Data and Other Information:
Thyme Care is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:
Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.
Related Companies: We may also share your Personal Data with our Related Companies for purposes consistent with this Privacy Policy.
Agents, Consultants and Related Third Parties: Thyme Care, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function.
Third-Party Analytics: We may allow third party service providers to use cookies, tracking pixels, identifiers for mobile devices, or similar technologies to collect information about your browsing activities over time and across different websites during and/or following your use of the Services that do not require user authentication. These companies, such as Google Analytics (www.google.com/policies/privacy/partners/) may use non- personally identifiable information about your visits to other websites, together with non- personally identifiable information about your purchases and interests from other online and offline sources, to provide ads about goods and services of interest to you. Legal Requirements: Thyme Care may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Thyme Care, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.
Health Information Exchange: Thyme Care may make your protected health information available electronically through an electronic health information exchange to other health care providers that request your information for their treatment purposes. In all cases the requesting provider must have or have had a treating relationship with you. Participation in an electronic health information exchange also lets us see other providers' information about you for our treatment purposes.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
International Visitors:
Our Site and Service is hosted in the United States and is generally intended for United States visitors. If you visit from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please be aware that you are transferring personal information to the United States. The United States does not have the same data protection laws as the European Union and some other regions. By providing personal information to us, you consent to the transfer of it to the United States and the use of it in accordance with this policy.
Additional Privacy Disclosures for California Residents:
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. At present, the California Consumer Privacy Act of 2018 (CCPA) does not apply to Thyme Care. If that were to change in the future, we will update this privacy policy.
Do Not Track:
Some web browsers incorporate a “Do Not Track” or similar feature that signals to websites that a user does not want to have his or her online activity and behavior tracked. We are committed to providing you with meaningful choices about the information collected through the Sites. However, like many websites, our Sites are not currently designed to recognize a “Do Not Track” signal from a web browser.
Children:
Children’s safety is important to us, and we encourage parents and guardians to take an active interest in the online activities of their children. Our Site is not intended for individuals under 18 years of age, and we do not knowingly collect or sell Personal Data from individuals under 18. Exclusions:

This includes, but is not limited to, information posted to any public areas of the Services, such as forums, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Thyme Care shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.
Links to Other Web Sites:
This Privacy Policy applies only to the Services. The Services may contain links to other web sites not operated or controlled by Thyme Care (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that Thyme Care endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.
Security:
Thyme Care takes reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet, text messaging, or email transmission is ever fully secure or error free. In particular, texts and emails sent to or from the Services may not be secure. Therefore, you should take special care in deciding what information you send to us via text message and/or email. Please keep this in mind when disclosing any Personal Data to Thyme Care via the Internet.
Other Agreements, Terms and Conditions:
Your access to and use of the Services is subject to any additional agreements, terms and conditions between you and Thyme Care.

We may limit the Services’ availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion. We do not represent or warrant that the Services, or any part thereof, are appropriate or available for use in any other jurisdiction.
